Description

The 2010 COP16 in Cancún, Mexico, led to the establishment of a Green Climate Fund (GCF), which supported the provision of long-term financing for developing countries. In a Treasury Department email attachment, European Union lawyers consider the legal implications that come with establishing such a fund. Most noteworthy is a fixation on the language used to establish the GCF, specifically the technicality that any establishment of a fund under COP’s authority has “specific inherent legal limitations.” More specifically, a fund established under COP would have “no international or domestic legal personality” and instead would have to “rely on the COP (and its own limited personality) or outside institutions…to carry out certain functions.”
