TREATY on the guarantees of the national security of Ukraine in connection to its accession to the Treaty on the Non-Proliferation of Nuclear Weapons 1968 The People's Republic of China the Russian Federation the United Kingdom of Great Britain and Northern Ireland the United States of America and France as permanent memberstates of the UN Security Council and nuclear-weapons states henceforth permanent memberstates of the UN Security Council and Ukraine as a state that inherited nuclear weapons of the former USSR on its territory and has the intention to acquire the status of a non-nuclear weapons state highly regarding the decision of Ukraine as a successor of the former nuclear state of the USSR to renounce its right to become a nuclear-weapons state guided by the desire to facilitate the strengthening of international strategic stability and security in conditions of further reduction of the existing nuclear arsenals in the world considering the unprecedented nature of Ukraine's intention to renounce nuclear weapons considering the necessity to provide Ukraine with adequate international guarantees by the nuclear weapons states permanent members of the UN Security Council in connection with its renunciation of the right to possess nuclear weapons and decision to accede to the Treaty on the Non-Proliferation of Nuclear Weapons agree the following Article 1 Permanent member-states of the UN Security Council shall respect the sovereignty political independence territorial integrity and inviolability of borders of Ukraine in accordance with the principles and norms of the UN Charter and the Final Act of the Conference on Security and Cooperation in Europe Article 2 Permanent member-states of the UN Security Council shall refrain from the threat or use of force or threat thereof in any shape against the territorial integrity and political independence of Ukraine and also from threat or use of economic coercion as means of achieving political and economic goals Article 3 Each permanent member-state of the UN Security Council shall consider unacceptable the actions of any nuclear weapons state in relation to Ukraine that constitute a violation of commitments under Articles 1 and 2 and should such actions take place shall undertake jointly with other permanent members of the UN Security Council the necessary measures toward their immediate cessation Article 4 Permanent member-states of the UN Security Council shall never threaten or use armed forces against Ukraine except in cases connected to the exercise of the inalienable right to individual or collective self-defense in accordance with the Article 51 of the UN Charter From the Nunn-Lugar collection of the National Security Archive taking into account special responsibility of the permanent member-states of the UN Security Council for upholding international peace and security in accordance with the UN Charter Article 5 Permanent member-states of the UN Security Council shall reaffirm in relation to Ukraine their earlier commitment not to use nuclear weapons against any non-nuclear weapon state party to the Treaty on the Non-Proliferation of Nuclear Weapons except in the case of an attack on themselves their territories or armed forces by such state in alliance with a nuclear-weapons state or acting jointly with in perpetrating or supporting such an attack Article 6 The purpose of such consultations is to develop and adopt a set of measures aimed at ensuring providing assistance to Ukraine in eliminating the threat to its national security violation of the state borders of Ukraine and its territorial integrity as well as the application of sanctions toward the state whose actions gave rise to such a situation Article 7 Ukraine ensures the destruction of all nuclear warheads located on its territory in the period of seven years after the accession to the Treaty on the Non-Proliferation of Nuclear Weapons Article 8 Permanent member-states of the UN Security Council recognize Ukraine's property rights to all components of nuclear weapons located on its territory or transferred following its independence to another state for disarmament and elimination Ukraine shall use the components of these nuclear weapons after their disarmament and elimination exclusively for peaceful purposes Article 9 The given Treaty enters into force at the time of Ukraine's accession to the Treaty on the Non-Proliferation of Nuclear Weapons in 1993 in six copies in Chinese Russia English Done in _ _ _ _ _ French and Ukrainian languages each of which has equal legal force For the People's Republic of China For the Russian Federation For the United Kingdom of Great Britain and Northern Ireland For the United States of America For France For Ukraine From the Nunn-Lugar collection of the National Security Archive At the initiative of any state parties to this Treaty immediate consultations shall be held between Ukraine and the permanent members of the UN Security Council should a situation arises that constitutes a threat to the national security of Ukraine
