Department of the National Security Corps The City of Prague and the District of Central Bohemia Prague 6 January 1977 Ref no OS 0011 02-77 DECISION Under section 160 sub-section 2 of the criminal code I am commencing proceedings concerning the crime of subversion under section 98 subsection 1 of the penal code which was committed by an as yet not entirely identified group of persons out of hostility towards the socialist social and state system of the republic by preparing and disseminating a document called “The Charter 77 Declaration” in a place that has not been exactly determined and at a time that has not been exactly determined the content of which is a crude attack on the socialist social and state system of the republic REASONS Through an investigation by organs of the Department of the National Security Corps of the City of Prague and the District of Central Bohemia it has been discovered that several as yet unidentified persons in Prague and elsewhere have out of hostility towards the socialist social and state system of the republic made and disseminated in Prague and other towns of the Czechoslovak Socialist Republic documents sic called “The Charter 77 Declaration ” which is a crude attack on the socialist social and state system of the Czechoslovak Socialist Republic The document also expresses the program of hostile elements for the support and fulfillment of which the campaign organizers have been winning over other anti-socialist elements Considering the content of the documents sic the extent of their dissemination as well as other aims of the organizers which are clear from the documents sic there is good reason to suspect that the crime of subversion of the republic has been committed under section 98 subsection 1 of the penal code and it has therefore been decided to commence criminal proceedings In view of the fact that the commencement of criminal proceedings could not be delayed and that it was not possible to reach a competent investigator the acting investigator has commenced criminal proceedings under section 170 subsection 1 of the criminal code N B Objections to this decision must be made within three days of the announcement of its delivery at the organ that has signed for it Objections will not delay the prosecution in any way Lt Jiří Soudný Acting Investigator Department of the National Security Corps The City of Prague and the District of Central Bohemia AMV V 33766 ČVS 3 120-77 sv 1 f…
